Court prohibits usage of ‘FoxMandal’ trademark by Bengaluru-based Law Firm

A Court in Delhi has issued an order preventing the Bengaluru-based law firm Fox Mandal & Associates from using the ‘FoxMandal’ trademark in any manner.
2.The decision came from District Judge Vidya Prakash, who presides over the Commercial Court at Patiala House Courts.
3.In addition, the court prohibited the use of the domain www.foxmandal.in, noting its resemblance to the plaintiff’s official website www.foxmandal.com.
4.According to the court, there is sufficient preliminary evidence to support claims of trademark infringement and passing off by the defendants.
5.The judge remarked that an average consumer could easily be misled into thinking the defendants’ services originated from the plaintiffs, as they were using a name and logo that were phonetically and visually similar to “FoxMandal.”
6.The lawsuit was initiated by FoxMandal and its Managing Partner, Somabrata Mandal, who accused Fox Mandal & Associates and its owners of unlawfully using their established trademark.
